General

Memories Made by Mya Photography has the intention to accurately & completely display everything shown on the website. No rights can be derived from the information placed on this website. Memories Made by Mya Photography accepts no liability for any damage resulting from the use of this site or the use of (image) information provided in this website. Memories Made by Mya Photography can not be held liable for material and/or immaterial damage during a photo session on location or in studio. The photos (website) may only be used by the owner, Daymia Orr. Visitors can view these photos, but do not have permission to use them in any way. When using the services of Memories Made by Mya Photography in any way, you automatically agree with these conditions.

Photo Sessions

All appointments are made through confirmation by the photographer. Appointments are not definitive until client confirms with a non-refundable booking fee of $25. After each photo session the photographer takes 3-5 business days to post unedited photos on website for clients to choose from. Once client chooses his/hers selected photos, images will be delivered via password protected photo album on website in an additional 3-5 days unless said otherwise. All on location photos will include travel costs of $0.54 cents per mile outside of Fontana,CA. Clients are obligated to relay any dissatisfaction to photographer directly during session. Complaints afterwards are considered not liable on behalf of the photographer. Recording or photographing your own content during session or with photographer's equipment is not permitted.

Photo Files

Clients will receive digital High Res files of agreed amount without logo or watermark in JPEG format. Additional files can be ordered up to 3 months after photo session for $7.50 per photo. Clients are not to receive any RAW/unedited files as final product.

Payment

A 50% deposit must be paid after booking a session, then remaining balance will be due upfront on location the day of the session. Failure to complete full payment will result in automatic cancellation with no opportunity for rescheduling or refund of previous payments.

Rescheduling

Rescheduling must be done up to 1 week before session date in order for session to not be cancelled. All deposits are transferable for rescheduling when the photographer is told 1 week in advance, and a date has been picked by the client. If the client chooses to reschedule, but does not communicate a new date, any previous payments are not to be refunded.

Cancellation Policy

Cancellations must be told to the photographer 48hrs in advance. Cancellations done 48hrs in advance or sooner will be reimburse 25% of any deposit made prior, excluding the booking fee. All clients that cancel after required time frame and/or does not arrive on session day, all payments made prior are non-refundable.

Copyrights of photos belong to the photographer of Memories Made by Mya Photography at all times. The customer gives the photographer permission to use the photos taken of the customer for promotional purposes on the internet and print matter. No reimbursement or refund is permitted for this. If the customer indicates they do not agree to the use of photos for promotional purposes, there will be a $30 surcharge. This price is calculated on the use of photos for promotions. Placing digital files on the internet in any way other than that provided by photographer are not permitted. After receiving digital files via flash drive, customer has the right to reproduce for his/her own use. Usage of files for commercial or non-profit companies is not allowed unless agreed by both client and photographer of Memories Made by Mya Photography. Memories Made by Mya Photography will delete digital files from archive/storage after 3 months unless files are being used for promotional purposes.

Liability

Memories Made by Mya Photography is not liable for any damage that has arisen for the other party, unless there is substantial negligence or intent on the part of the photographer or person(s) engaged by it. Memories Made by Mya Photography is not liable for color deviations or photo prints on products not delivered by it. Memories Made by Mya Photography is not liable for delivering less or less good photos than normal due to unforeseen circumstances that fall outside the influence of the photographer. (i.e: Weather conditions, instructions that are not followed)
